R. Jane Lynch
From working for several years in the risk management group of a major Southern California real estate firm to opening her own practice in 2006, R. Jane Lynch has extensive experience and expertise in all aspects of real estate, with an emphasis on complex insurance coverage, business litigation, risk management, and construction disputes. She has represented real estate developers, home builders, lenders and investors in litigating claims that could have been mitigated or avoided altogether through better risk management at the inception of the Project.
Ms. Lynch's litigation experience includes homeowner and homeowner association construction defect disputes, purchase and sale agreement arbitrations and insurance coverage disputes with carriers. She has represented residential real estate developers in Calilfornia, as well as Nevada, Arizona and Texas and has represented insureds in tort litigation, including environmental clean-up and food poisoning cases. Ms. Lynch has acted as coverage counsel and litigation counsel to her clients in hundreds of mediation proceedings that resulted in settlement.
With an impressive track record of negotiating and implementing project-specific and corporate "rolling" wrap-up or Owner Controlled Insurance Programs ("OCIPs") for residential construction projects, Ms. Lynch has advised and consulted with clients and their insurance brokers to obtain the broadest insurance coverage available, specifically tailored to the project at hand. In order to have a successful project, this process requires a fully-integrated, comprehensive risk management strategy that includes project document review along with policy form analysis and modification. This strategy is designed to minimize claims, reduce the insurer's ability to deny claims and to avoid joint venture and lender liability claims.
Ms. Lynch's approach and strategy includes consultation and familiarity with third-party quality control experts and risk management vendors, often required by insurers on projects they insurer. Careful and efficient compliance monitoring can effectively reduce the loss of precious insurance proceeds to resolve claims.
Ms. Lynch has co-authored a number of publications and has been a featured speaker on complex insurance coverage, risk management, mold and related construction issues at local, regional and national conferences of a number of industry and professional organizations, including the National Association of Home Builders and the National Business Institute.
